Problems can arise with respect to Child Custody, Visitation, and Child Support when these couples break off the relationship. In a perfect world the mother and the father are amicable in such a situation, and do what is in the child or childrens best interest. However, it is much safer, and highly recommended, that you obtain Court orders with respect to custody, visitation, and support issues, so that the mother and father each know their respective rights and obligations, and so that there are no ambiguities regarding the same. This article will discuss the issue of children who are born out of wedlock from both the mother and the fathers prospective to give you a general understanding of the law in California regarding children born out of wedlock. The Mothers Prospective The mother of a child that is born out of wedlock has a unique advantage in that she does not normally have to prove that the child is hers. If hospital records indicate that a female has given birth to a child, and the birth certificate that is issued upon the birth of a child indicates that the female gave birth to the child, than there is usually no issue with the mother showing that she is the paternal mother. The mother of a child born out of wedlock will automatically be entitled to full custody of a child absent a Court order indicating otherwise. She may give the father visitation if she so chooses, or she can deny visitation to the father absent a Court order. All minor children in California have a right to receive child support pursuant to a statutory guideline. (The subject of Child Support will be covered in a forthcoming separate article). If the mother of a child who is born out of wedlock wants to obtain child support from the father, she will have to file and serve a Petition to Establish Parentage on the father, and an Order to Show Cause for child support with the appropriate Court. If the mother is on welfare or Aid to Families with Dependent Children, the District Attorney in the county in which the mother resides will ordinarily aid in this process so that the County gets reimbursed for the aid that is being provided to the mother by the County. If a father voluntarily accepts paternity, than the Court will decide each partys rights to custody, visitation, and child support based upon the facts in the case. If the father denies that he is the father, he may request that a DNA test be done to determine whether he is the father. Once this process is completed than the Court will determine each partys rights. If a mother is not sure who the real father of a child is, she will have to file a Petition to Establish Parentage on each potential father. The Court will ordinarily allow the father visitation or custody rights to the child unless it can be shown that it is not in the best interest of the child for the father to have such rights. The Fathers Prospective The father of a child born out of wedlock has no rights to Custody, Visitation, or Child Support unless they obtain a Court order for the same. If a father wants to have rights to custody, visitation, or child support for a child born out of wedlock, the will have to file a Petition to Establish Parentage, and an Order to Show Cause for Custody, Visitation, and/or Support. The mother of the child may or may not agree that the father is the true father of the child. Either party may request that a DNA test be done to prove whether or not the father is the paternal father of a child. Once the Court determines paternity, the Court will than look at many factors with respect to rights to Custody, Visitation, and Support. The Court will ordinarily allow the father visitation or custody rights to the child unless it can be shown that it is not in the best interest of the child for the father to have such rights. The Mother and Fathers Prospective as a Whole The Court will always try to determine what is in the childrens best interest when determining who will have Custody and Visitation rights to a child or children. This can be a long and expensive process if litigated. It is recommended that a Mother and Father try to informally work out a Custody and Visitation plan for a child or children, and then get a Court Order which reflects the agreement of the mother and father. If you cannot informally work it out than the Court will decide the issue for you. Support of the child or children will be determined by the Court using a statutory formula which is based on both parties income, the percentage of time each person has with the child or children, and other factors. By Keith Thirgood How many times has someone you’ve called said, “Why don’t you send me some information on your company”? Ask yourself, before you send anything: How will this be dealt with once it arrives at that person’s desk. Aren’t they already suffering from information overload? On the one hand, people say they they need more information in order to make the decision just to meet with you, let alone to agree to buy or hire. On the other, they have more information about everything than they know what to do with. The problem is, your prospects are not usually looking for information. They are usually, politely, asking you to go away. Most salespeople at this point shovel a whole lot of information at their prospect, hoping something will stick. A more effective way to respond to your prospect’s request for more information is to send something that reaches them at a gut level. It doesn’t have to be overwhelming, a subtle message can be as effective as a bold one, as long as it connects. How to achieve that connection on paper or a website is, of course, the big challenge. Upon receiving your marketing material your prospect will ask themselves, “Is it worth my time to look at this? and “Do I have the time to look at it now?” This happens in the first glance. If your material doesn’t elicit a yes to one or both of these questions, you have failed. When done right, the connection is made with no effort on your prospect’s part. Suddenly they recognize that someone is saying all the right things. Information alone does not have the power to move a prospect further along the sales path. Making a connection does. And it can happen to your prospect in the blink of an eye. A well known, well received, Saturn commercial showed how in seconds we can come to a profound understanding and connection with an advertiser. A young woman calls the Saturn guys and asks a favour for when the new car is delivered to the showroom. We see her and her nice, average-Joe kind of fellow looking over the new car. He’s paying lots of attention to the macho dashboard details and such and she seems a little nervous. As he turns to examine the rest of the interior, we see in a flash, (in one version, we see only a few square inches) what he sees–a baby seat. We have all the information we need. We know precisely, now, what this story is all about. We cannot help but be caught up in the drama because it is up to us to make the story up for ourselves, as it unfolds in the remaining few seconds: in his eyes, surprise and (very obvious) love for the lady. On her face, the question: how will he take the news? Then the happily-ever-after answer. The connection with the audience has been made. The thought of a mother-to-be doesn’t make me go all mushy, and I’ve never even been in a car with a baby seat. But this reached me at a profound, personal level. I’m ready to look at a Saturn when my latest Honda is ready to be traded in. You may not be selling cars, but the principle is the same. You must connect strongly and quickly, and the best way to do that is at the gut level. That gut level connection is often all your prospect needs to know before they will meet with you. The average person has a unfathomable reserve of information that is accessed, processed, understood and felt in something approaching the speed of light. That kind of information–gut level understanding–is more powerful than anything else a marketer can thrust on a prospect. Does it really work that way? Does watching a boy call his grandfather from the beaches of Dieppe on his cell phone to say thanks work? Ask Bell. Not only does an image or a concept do the work of a thousand words, it does it in 1/1000th of the time, and with a thousand times the punch. This is not to say you must include pictures with your marketing material. A good writer can paint vivid pictures with text in people’s minds, using the power of a metaphor or a story. The lesson: Don’t turn your marketing materials into something like a manual, catalogue, lecture, or diatribe. Use the powerful informational forces already resident in your target market. Work to understand who they are and why they might want you instead of someone else. Speak in their language, and keep the focus on them. Instead, focus on making several small changes that can affect the quality of your relationship right away. Once you generate some positive energy flow, itll be easier to tackle the larger issues. Plus, youll be more motivated to put forth the effort and to keep trying. Here are seven easy ways you can improve your marriage: 1. Schedule date nights on a regular basis. Did you know research by Idaho State University shows that one of the secrets to a happy marriage is scheduling regular dates? This study involving 132 couples found those who went on dates more often (the average was six dates a month) were more likely to be satisfied with their marriage than those who spent less time together. So get out your calendar and schedule some times for you and your spouse to go out and spend time together doing something you both enjoy. You might have dinner in a restaurant, go dancing, see a movie or play, or listen to live music. The important thing is youre spending time together and having fun. If you have children and have been neglecting this part of your relationship for a long time because you dont want to leave the kids with a babysitter, theres probably something else going on underneath the convenient reason. So youre giving your partner important information about how you really feel about him (or her) when you show disrespect. Start becoming more aware of your behavior when your spouse is talking to you. You might ask your spouse if she (or he) feels disrespected during conversations and interactions with you. But dont ask for honest feedback unless youre prepared to receive it without getting defensive. The goal is to become more self-aware and improve your relationship with your partner. 3. Take the television out of the bedroom. You may be surprised at the research findings involving late-night TV. A survey by Italian psychologist Serenella Salomoni found that among couples over the age of fifty, those who kept TV out of the bedroom had sex an average of seven times a month compared with 1.5 times a month for couples with TVs. The implication is that late-night TV can translate into a lot less sex for many couples. Its easy to see how this could happen over time without a couple even stopping to think about the long-term effects on their sex life and intimacy. Watching television becomes a habit and the path of least resistance. If removing the television from your bedroom sounds too drastic, at least consider initiating a conversation with your spouse about these findings and whether your marriage might benefit from less TV watching in the evenings. 4. Make time for vacations. The Wisconsin Medical Journal reported that when 1500 women were asked how often they took a vacation, 20% said that it had been six years or more. These non-vacationers were more likely to be stressed and unhappy in their marriages. Every day life can get so bogged down with details, work, and loose ends that fun and romance can easily become buried and neglected. There are a dizzying array of options available, all claiming to be superior to the rods next to them. Before you jump into a decision you will regret, it always pays to educate yourself on just what it is you need to, and therefore should, acquire. The first step in acquiring a fishing rod is to purchase a blank. This refers to the rod proper, which is a shaft of varying materials on which you mount a reel and some line. Shafts can be purchased in three different materials: graphite, fiberglass, and bamboo. Bamboo rods are generally used for fly fishing and can be quite expensive. Fiberglass rods are generally for beginner use, and are the type you find at your local Wal-Mart or other department type stores. Graphite is the material of choice for serious fisherman, and can be found many places online, or at your local sporting goods stores. For this article, we will concentrate on graphite rods. Fishing rods come in varying strengths and will be measured in terms of modulus. Modulus refers to the density of the weave of the material from which the rod blank is fashioned. Graphite rods generally come with a modulus between 33 million and 60 million. The higher the modulus, the stiffer the rod will be. The higher modulus rods will also be lighter, faster, and more sensitive. As a trade-off however, high modulus rods are more brittle than lower modulus fishing rods. Sensitivity is also an important factor when choosing a rod blank. As a general rule, the deeper the water that you are fishing in, the higher sensitivity you will want, so that you can feel the more subtle bites. The last thing you want is to have to go home and tell the story about the one that got away! One factor that affects sensitivity of your rod, besides material of the shaft, is the handle construction. Usually the handles are made from cork or foam. You should ensure that the handle feels comfortable in your hand and that it is not too soft, otherwise you may not be able to feel those aforementioned subtle bites. Also, if you are fishing with any type of artificial bait, it is crucial to be able to feel the movement of the bait through the rod to ensure that you are enticing the fish in the proper manner. How many profiles are out there that will admit that they don’t like to cuddle or try to avoid their family at all costs? If you want to write a profile that really gets you noticed, you have to move beyond the tired old cliches and really gets specific about YOU. The profile about is too boring and too general. It just won’t stand out from the millions of others out their in the online dating world. Be Specific It’s important to focus in on one or two very specific features that make you unique - features that are positive and uplifting, that will make others want to be with you and get to know more about you. If you are a mountain climber, mention the most challenging trip you’ve been on. If you are involved in the theater, a brief mention of an an unusual role you’ve played is a great conversation starter. And remember, you don’t have to have a long profile, just an intriguing one. After all, others may be reading through an awful lot of profiles, and if yours is short but fascinating, you’re more likely to get their attention than if you ramble on endlessly. Finally, mention what you’re looking for in a companion - and not just physical attributes. Talk about the kind of personality you think would mesh well with yours, and the things you would enjoy doing together (movies? boating? travel? just hanging out?) If you are intimidated by the prospect of writing a profile, take the time to read through some before writing your own and take some notes. Write down key words and phrases and like and the types of information that you found especially interesting, then incorporate that type of information into your own profile. After all, if it captured your attention, it is likely to work for others as well. You might also write yours up and have a friend read it over before you actually post it. Ask them to give their honest opinion - does it portray you accurately? They may give you some great suggestions that you wouldn’t have thought of.
